Terms of Service
Effective Date: January 1, 2026 | Last Updated: January 1, 2026
Please read these Terms of Service ("Terms") carefully before using the website at https://delaneylawllc.com(the "Site") or engaging the services of Brendan M. Delaney Law Firm ("Company," "we," "us," or "our"). By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our website or services.
1. Acceptance of Terms
By accessing or using our website, requesting a service quote, scheduling an appointment, or engaging our services in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Brendan M. Delaney Law Firm. We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Site. Your continued use of the Site or our services after any changes constitutes acceptance of the revised Terms.
2. Description of Services
Brendan M. Delaney Law Firm provides the services described on this website, including but not limited to:
- Criminal Defense
- Personal Injury
- Family Law
The scope of any representation, and the fee for it, is set out in a written fee agreement signed by you and by Brendan M. Delaney Law Firm before the representation begins.
3. Consultations and Fees
The initial consultation is free and carries no obligation. It exists so you can describe your situation and so Brendan can explain the charge or claim, the range of outcomes that are realistic on those facts, and what representation would cost.
Fees depend on the nature and complexity of the matter and are quoted to you in writing before you decide. No fee figure appears on this website because no honest one could apply to every case. Nothing said in a free consultation commits you to hire this firm.
4. Payment Terms
Payment terms are governed entirely by your signed fee agreement, including any retainer, the billing arrangement, and how any unearned balance is handled if the representation ends. Client funds are held in accordance with the South Carolina Rules of Professional Conduct.
5. Your Responsibilities
When using this website or engaging this firm, you agree to:
- Give accurate and complete information about your matter, including facts that are unfavorable to you
- Tell us promptly about court dates, deadlines, and any contact from law enforcement or an insurer
- Not use this website for any unlawful purpose or in violation of any applicable law
- Not attempt to interfere with or disrupt the operation of this website
- Not reproduce or distribute this website's content without written permission
6. Appointments
Court schedules move without notice, and a hearing that runs long can affect appointment times. If a meeting has to be moved, this office will tell you as soon as it knows. Please give as much notice as you can if you need to reschedule.
7. No Guarantee of Outcome
Nothing on this website is a promise or guarantee about the result of any legal matter. Every case turns on its own facts, its own evidence, and the discretion of the court. Prior results do not predict or guarantee a similar outcome in your case.
- No attorney client relationship: Submitting a form, sending an email, or calling this office does not by itself create an attorney client relationship. That relationship begins only when Brendan M. Delaney Law Firm and you sign a written fee agreement.
- Do not send confidential details before we are engaged: Because no relationship exists until an agreement is signed, information you send beforehand may not be protected by the attorney client privilege. Keep first messages brief.
- Not legal advice: The content on this site is general information about South Carolina law and is not legal advice for your situation. Deadlines in criminal and injury matters are strict, so speak with an attorney promptly.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BRENDAN M. DELANEY LAW FIRM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR WEBSITE OR SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total aggregate liability for any claim arising out of or related to our services shall not exceed the total amount paid by you for the specific service giving rise to the claim.
9. Disclaimer of Warranties
OUR WEBSITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.
10. Indemnification
You agree to indemnify, defend, and hold harmless Brendan M. Delaney Law Firm, its owners, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney fees) arising out of or in connection with your violation of these Terms, your use of our website, or your engagement of our services.
11. Intellectual Property
All content on our website, including text, graphics, logos, images, videos, and software, is the property of Brendan M. Delaney Law Firm or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from any content on our website without our prior written consent.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of SC, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or our services shall be resolved exclusively in the state or federal courts located in SC, and you consent to the personal jurisdiction of such courts.
13. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
14. Entire Agreement
These Terms, together with our Privacy Policy and any signed fee agreement provided to you, constitute the entire agreement between you and Brendan M. Delaney Law Firm regarding your use of our website and services. These Terms supersede any prior agreements or understandings, whether written or oral.
